Terms of Service

These terms govern homeowner requests, contractor accounts, managed Meta advertising campaigns, campaign funding, direct lead attribution and delivery, and the optional shared lead marketplace.

Platform Role

South Florida HVAC Help is a homeowner request, advertising-management, lead-delivery, and optional lead-marketplace platform. We help connect homeowners who need HVAC help with independent HVAC contractors serving South Florida. We are not an HVAC contractor and do not perform HVAC repairs, installations, maintenance, estimates, warranties, or emergency services directly.

Contractor Accounts and Business Information

A contractor may create an account and provide business information such as company name, contact details, service areas, service types, license information, and website. Creating an account or configuring a campaign does not create a charge or publish an advertisement.

We may suspend or terminate accounts for fraud, misuse, security concerns, legal or regulatory risk, nonpayment, unauthorized access, chargeback abuse, inaccurate business information, or violation of these terms.

Managed Advertising Campaigns

The contractor may configure a managed advertising campaign by selecting targeting, service categories, urgency preferences, budget, destination, ad copy, and approved creative. By authorizing campaign funding and clicking Run Campaign, the contractor instructs South Florida HVAC Help to create, publish, monitor, pause, resume, and administer advertising through connected advertising platforms, including Meta, using the selected settings and available platform permissions.

Campaigns may require platform review, advertising-platform review, identity verification, Page or ad-account access, approved creative, an active lead form or website destination, and compliance with advertising policies. A campaign may remain pending, fail to publish, be rejected, or be paused by the advertising platform. We may pause or decline a campaign that appears unlawful, misleading, unsafe, noncompliant, technically invalid, or likely to create material risk.

The contractor is responsible for the truthfulness and legality of business claims, licenses, offers, pricing statements, warranties, trademarks, testimonials, creative assets, and destination content supplied or approved for the campaign.

Campaign Funding, Advertising Spend, and Platform Fees

Campaign funding is a separate one-time payment from any optional marketplace subscription. The checkout page displays the funding amount before payment. Confirmed funding may be allocated between advertising media spend and disclosed platform or management fees according to the campaign configuration and applicable checkout terms.

The contractor authorizes the platform to use the funded media budget for the connected campaign. Advertising spend is recorded from the advertising platform when available and may be delayed, adjusted, rounded, or restated by that platform. The system may automatically pause a campaign when recorded spend reaches the funded media budget or when continued spending would create an unfunded balance.

Funding a campaign does not guarantee that it will publish immediately. No active advertising should begin until the campaign configuration is complete and the contractor separately initiates the Run Campaign action. If a campaign cannot be launched, unused funds remain subject to applicable payment, refund, correction, and dispute rules and any non-refundable amounts clearly disclosed at checkout.

Lead Attribution and Direct Delivery

The platform may use campaign, ad-set, ad, form, URL, cookie, pixel, and other attribution identifiers to determine which contractor campaign generated a homeowner request. When a request is attributed to an active contractor-funded campaign, the platform may assign the request directly to that contractor and unlock the homeowner details needed to follow up on the specific request.

Direct campaign delivery does not use optional marketplace claim credits. If attribution is unavailable, ambiguous, invalid, or unmatched, the request may be held for review, routed through the optional marketplace, or otherwise handled according to platform operations and homeowner consent.

The contractor may use homeowner information only to respond to the related HVAC request. Selling, redistributing, publishing, scraping, enriching for unrelated marketing, or using the information for unrelated solicitation is prohibited.

No Guarantee of Leads or Business Results

Advertising performance is uncertain. We do not guarantee impressions, clicks, form submissions, lead quantity, lead quality, homeowner response, exclusivity, contactability, appointments, estimates, jobs, revenue, return on ad spend, cost per lead, or any other commercial outcome.

A homeowner may provide inaccurate information, fail to respond, cancel, choose another contractor, decline service, or submit more than once. Advertising platforms may limit delivery, reject creative, change attribution, delay reporting, or spend differently than expected. These outcomes do not by themselves establish a platform error or right to a refund.

Campaign Pausing, Resuming, and Termination

Contractors may use available portal controls to request a pause or resume. Advertising-platform status changes may not be instantaneous. The platform may automatically pause campaigns for exhausted funding, payment problems, compliance concerns, technical errors, security risks, account restrictions, or platform-policy changes.

A paused campaign may continue to show delayed spend, delayed leads, or reporting updates associated with activity that occurred before the pause was fully processed. Termination of an account may disable campaign controls and access to future leads while preserving records required for legal, accounting, security, support, and dispute purposes.

Optional Shared Lead Marketplace

The shared marketplace is a secondary product. Contractors may browse redacted inventory without purchasing a campaign or subscription. A valid marketplace subscription and sufficient credits are required to claim an additional shared lead and unlock its homeowner contact information.

Marketplace subscription prices, included credits, renewal dates, rollover limits, and other material terms are displayed before checkout. Marketplace subscriptions recur until cancelled according to the billing terms. Campaign funding does not provide marketplace credits, and marketplace credits do not fund advertising campaigns.

Marketplace Claims and Digital Delivery

Before a marketplace claim, the contractor must confirm the displayed credit cost and acknowledge the claim policy. When a claim succeeds, the stated credits are deducted and the homeowner information is delivered through the portal and, when enabled, transactional email.

Marketplace subscriptions, claimed leads, and used credits are non-refundable except where required by law or where South Florida HVAC Help approves a correction for a verified duplicate, unauthorized transaction, or documented platform delivery error.

Payment Processing and Disputes

Payment information is processed by third-party payment providers. We do not store complete card numbers. Contractors agree to contact support promptly when they believe a billing, campaign, spend, or lead-delivery error occurred so it can be investigated.

We may provide payment processors or issuing banks with relevant authorization and fulfillment evidence, including accepted policy versions, account records, campaign configuration, funding records, advertising identifiers, spend records, lead-delivery records, subscription details, credit ledgers, timestamps, email events, hashed technical evidence, and related communications. Nothing in these terms eliminates non-waivable cardholder or consumer rights.

Homeowner Requests and Consent

Submitting a homeowner request authorizes South Florida HVAC Help and participating independent HVAC contractors to contact the homeowner regarding that specific request, subject to the choices shown on the form and applicable law. Submission does not guarantee contractor availability, a response, an estimate, an appointment, or service.

This platform is not a 911 or emergency dispatch service. For a life-safety emergency, contact emergency services immediately.

Independent Contractor Responsibility

All HVAC work is performed by independent contractors. Contractors are solely responsible for licensing, insurance, estimates, permits, workmanship, warranties, scheduling, communications, taxes, employment practices, advertising claims, and compliance with applicable laws and industry requirements.

Any HVAC service agreement is between the homeowner and the contractor. South Florida HVAC Help does not endorse or warrant a contractor’s work and is not responsible for property damage, personal injury, pricing disputes, service delays, warranties, or other consequences of contractor performance.

Acceptable Use and Security

Users must provide accurate information, use the platform lawfully, protect account credentials, and avoid conduct that disrupts systems or harms other users. Unauthorized access, false homeowner requests, fraudulent campaigns, misleading advertising, credential sharing, payment evasion, data scraping, and misuse of homeowner information are prohibited.

  • Homeowner requests must reflect a genuine service need.
  • Contractor targeting and advertising claims must be accurate and lawful.
  • Homeowner information may be used only for the related service request.
  • Users may not circumvent funding, campaign, subscription, credit, attribution, or access controls.
  • Fraudulent disputes, account manipulation, or misuse of delivered data may result in suspension or termination.

Limitation of Liability

To the maximum extent permitted by law, South Florida HVAC Help is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from platform use, advertising-platform actions, campaign performance, contractor conduct, homeowner behavior, lead outcomes, lost profits, or inability to access campaigns or inventory. To the maximum extent permitted by law, aggregate liability is limited to the amount paid to South Florida HVAC Help during the three months preceding the event giving rise to the claim.

Changes and Contact

We may update these terms and policy versions. Material campaign, funding, subscription, or claim actions may require a new acknowledgment. Continued use after an effective update constitutes acceptance where permitted by law.
